Terms of Use

These Terms of Use govern your access to and use of the Lotus app and website. By creating an account or using Lotus, you agree to these terms. Please read them carefully — including the important note that Lotus is not a medical or contraceptive tool.

1. Acceptance of these terms

By downloading, accessing, or using Lotus (the “Service”), you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old and able to form a binding contract to use Lotus. By using the Service, you confirm that you meet these requirements.

3. The Service

Lotus is a companion app. One partner (the “Owner”) provides cycle information; the other partner (the “Companion”) receives a quiet daily briefing with plain-language summaries and suggestions derived from it. The Companion does not see the Owner’s raw data. We may add, change, or remove features over time.

4. Accounts

You can create an account using Sign in with Apple, Google, or email. You are responsible for the activity that happens under your account and for keeping your sign-in method secure. Provide accurate information and keep it up to date.

5. Pairing and consent

Lotus is designed to be used with the knowledge and consent of both partners. The Owner controls what is shared and may pause, edit, or unlink the Companion at any time. You must not use the Service to track, monitor, or share information about any person without their clear consent. Using the Service to surveil or coerce another person is strictly prohibited and may be unlawful.

6. Not medical advice

Lotus is for general informational and relationship-support purposes only. It is not a medical device and does not provide medical advice, diagnosis, or treatment. It is not a method of contraception and must not be relied on to prevent or achieve pregnancy. Cycle estimates may be inaccurate. Always consult a qualified healthcare professional for medical questions, and never disregard professional advice because of something in the app.

7. Subscriptions, free trial, and billing

  • Lotus offers a 7-day free trial, after which a paid subscription is required to keep using paid features.
  • Subscriptions are offered at $4.99 per month or $39.99 per year (prices may vary by region and may change).
  • Purchases are processed and billed through your Apple App Store account. Payment is charged to your Apple ID at confirmation of purchase.
  • Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
  • You can manage or cancel your subscription, and turn off auto-renewal, in your Apple App Store account settings. Deleting the app does not cancel your subscription.
  • Except where required by law, payments are non-refundable; refund requests are handled by Apple under its policies.

8. Acceptable use

You agree not to:

  • Use the Service for any unlawful, harmful, or abusive purpose, including tracking someone without consent;
  • Reverse engineer, decompile, or attempt to extract the source code of the Service, except as permitted by law;
  • Interfere with, disrupt, or place undue load on the Service or its infrastructure;
  • Attempt to gain unauthorized access to any account, system, or data;
  • Resell, sublicense, or commercially exploit the Service without our written permission.

9. Intellectual property

The Service, including its software, design, text, and graphics, is owned by Lotus and its licensors and is protected by intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose. You retain ownership of the content and data you provide.

10. Third-party services

The Service relies on third parties such as Apple (for authentication, Apple Health, and subscriptions), Google (for sign-in), and PostHog (for product analytics). Your use of those services is governed by their own terms and privacy policies, and we are not responsible for them.

11. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or accurate, including any cycle estimates or suggestions.

12. Limitation of liability

To the fullest extent permitted by law, Lotus will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, relationships, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the claim or USD $50.

13. Indemnification

You agree to indemnify and hold harmless Lotus from any claims, losses, or expenses arising out of your misuse of the Service or your violation of these terms or applicable law.

14. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these terms or use the Service in a way that could harm others or us. Sections that by their nature should survive termination will do so.

15. Changes to these terms

We may update these terms from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, notify you in the app. Continuing to use the Service after changes take effect means you accept the updated terms.

16. Governing law

These terms are governed by the laws of the jurisdiction in which Lotus is established, without regard to conflict-of-law rules. Mandatory consumer-protection rights in your country of residence are unaffected.
